Medi-Smart.com Scrubinator Photo Contest

OFFICIAL RULES

Introduction:  Medi-Smart.com, a website owned and operated by QuinStreet, Inc. (“QuinStreet” or “Sponsor”) is conducting a photo contest (the "Contest").

NO PURCHASE IS NECESSARY TO ENTER OR WIN.  CONTEST VOID WHERE PROHIBITED BY LAW.

Eligibility:  Entrants must be at least 18 years of age at the time of entry, legal residents of the 50 United States and the District of Columbia. Void in Puerto Rico and where prohibited by law or regulation. The Contest is subject to all applicable federal, state and local laws.  Any entries not eligible for any reason will be disqualified from receiving any award.  Any entrant that is provided an award and is later determined to have been ineligible, will be required to return such award of monetary or material value within 7 days upon notification of disqualification and ineligibility. Employees of QuinStreet and its subsidiaries, affiliated companies, agents, and their immediate family (defined as parents, spouse, children, siblings, grandparents), and all those with whom such employees are domiciled, are NOT eligible to participate in the Contest.

To enter:  Entrants can enter by (1) E-mailing  one photo to MediSmartQS@gmail.com  with the subject: “Scrubinator Photo Contest” between January 19, 2011 and April 20, 2011. Sponsor is not responsible for lost, late, illegible, and misdirected entries. Such entries are not eligible and will be disqualified. Limit one (1) entry per person, per Facebook account and per e-mail address, regardless of the method of entry, or whether more than one person uses the same e-mail address.   Entrants must have an email address to enter the Contest.

Scrubinator Photo Award: From January 19, 2011 to April 20, 2011, Medi-Smart.com will award four $250 gift certificates to Scrubs and Beyond to those with the most colorful, interesting and unique scrubs as determined by Sponsor. All federal, state and local taxes and any other costs and expenses not specifically stated herein as being awarded are the award recipient’s sole responsibility. No transfer, assignment, cash redemption, or substitution of prize will be issued except that QuinStreet may substitute a prize with one of equal or greater value, at its sole discretion.  Odds of receiving an award depend on number of eligible entries received. Popularity on Facebook is one factor in the judging criteria.

Award Notification:  The award recipient will be notified by e-mail on or about April 20, 2011.  The potential award recipient must respond to his or her notification within 7 days of receipt or he or she will be disqualified.  Noncompliance with the foregoing, these official rules, Sponsor’s inability to contact a potential award recipient within a reasonable time period or prize notification returned as non-deliverable, may result in disqualification and, at Sponsor’s discretion, a runner-up may be notified.

By accepting any award, the recipient grants QuinStreet and its designees the right to use his/her name, city and state of residence, likeness and biographical information in any and all media for any purposes throughout the world in perpetuity, without additional compensation, notice or permission, unless prohibited by law.

Limitation of Liability: QuinStreet and its affiliates will not be responsible for late, lost, stolen, misdirected, damaged, incomplete, or illegible entries; or entries that are lost due to computer, Internet, or electronic malfunction. QuinStreet reserves the right to cancel or modify the Contest and award the prize through an alternate means if fraud or technical failure compromises the integrity of the Contest, as determined by it in its sole discretion. Entrants agree that QuinStreet, its promotion partners, affiliates, agencies, and their respective employees or officers shall not be liable for injury, losses, damages, or costs of any kind resulting from participation in this Contest or acceptance of or use or misuse of an award or parts thereof. Entrants completely release Facebook in connection with this Contest. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the person in whose name the Facebook account is registered.

Additional Terms:  Entrants acknowledge that this Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook.  Any questions, comments or complaints regarding the Contest must be directed to QuinStreet, not Facebook.

Governing Law; Venue:  This Contest will be governed by the laws of the State of California without reference to its choice of law principles. The entrants agree to submit to the exclusive jurisdiction of the state courts located in San Mateo County in the State of California and the federal courts located in the Northern District of California, with respect to disputes hereunder.
